Conditions of Travel
& Information on the EU Package Travel Directive
Before making a booking, we kindly ask you to read the General Terms and Conditions carefully, as you are entering into a contractual agreement between FINNSPIRIT and yourself from the moment of booking. The person making the booking accepts these conditions on behalf of all persons in the group and is responsible for all payments due. By submitting a booking, you confirm to us that you comply with these regulations.
General Terms and Conditions of Travel (GTC) of FINNSPIRIT REISEN for trips in Finland. These General Terms and Conditions of Travel supplement the statutory provisions and govern the contractual relationship between you, the traveler, and us, the tour operator FINNSPIRIT REISEN, owned by Rebecca Lang (hereinafter “FINNSPIRIT”). These FINNSPIRIT GTC apply to the booking of trips in and to Finland.

1 Conclusion of the Travel Contract
1.1 By submitting a registration, the customer makes a binding offer to FINNSPIRIT to conclude a travel contract based on the travel itinerary, the information regarding the trip in question in the travel or online brochure, and these ARB. The registration is also made by the registrant on behalf of all participants listed in the registration, for whose contractual obligations the registrant is liable as for his or her own obligations, provided that the registrant has assumed a corresponding separate obligation through an express and separate declaration. The registration may be made verbally, in writing, by telephone, or electronically (via email). For electronic registrations, FINNSPIRIT will immediately confirm receipt of the registration electronically.
1.2 The travel contract is concluded upon FINNSPIRIT’s acceptance of the registration. FINNSPIRIT confirms the conclusion of the contract to the registrant via a travel confirmation on a durable medium, e.g., by email (in writing only in the case of Art. 250 § 6 (1) sentence 2 EGBGB), and sends the security certificate. The insolvency insurance underlying the security certificate protects customer funds against the organizer’s insolvency. If the content of the travel confirmation differs from the content of the registration, and provided that the pre-contractual information obligations have been fulfilled, this constitutes a new offer from FINNSPIRIT, to which FINNSPIRIT is bound for 10 days. Within this period, the customer may accept the new offer by means of an express or implied declaration (e.g., payment of the deposit), and the travel contract is concluded based on the terms of this new offer.
2 Payment
2.1 Payments toward the travel price prior to the end of the trip may only be requested or accepted if FINNSPIRIT has a customer funds protection agreement in place, FINNSPIRIT informs the customer of this in accordance with § 651t of the German Civil Code (BGB), and a security certificate within the meaning of § 651r(4) BGB is provided to the customer in advance.
2.2 Upon receipt of the booking confirmation and the security certificate, a deposit of 20% of the travel price is generally due and payable. An exception applies to individual or flat-rate travel services for which FINNSPIRIT must itself make advance payments in full to its service providers shortly after the trip is booked (e.g.,
accommodations & activities, flights at special rates, seat reservations, admission tickets, etc., such as for custom-designed individual or private tours or other trips). In this case, full or partial payment may become due upon delivery of the security certificate and travel documents. FINNSPIRIT will inform the customer of the amount of the down payment prior to the conclusion of the contract.
2.3 The deposit will be credited toward the total travel price. The balance of the total travel price is due 28 days before the start of the trip and must be paid once it is certain that the trip will take place—in particular, once it can no longer be canceled by FINNSPIRIT pursuant to Section 7.1—and must be received by FINNSPIRIT without being requested. The date on which the payment is credited to FINNSPIRIT’s account shall determine whether the payment was made on time. For last-minute bookings made within the 28-day period prior to the start of the trip, the full travel price is due and payable under the conditions specified above.
2.4 If the customer fails to make the down payment and/or the balance in accordance with the agreed payment due dates, FINNSPIRIT is entitled, after issuing a written reminder setting a deadline, to withdraw from the travel contract and to charge the customer cancellation fees in accordance with Sections 5.2 through 5.4.
3 Services
3.1 The scope and nature of the services contractually owed by FINNSPIRIT are set forth in FINNSPIRIT’s service description in the brochure, online brochure, website, or catalog pertaining to the trip in question, or in FINNSPIRIT’s specific trip itinerary, in conjunction with the individual booking confirmation. If an individual itinerary is put together at the customer’s request, FINNSPIRIT’s obligation to provide services arises exclusively from the corresponding specific offer made to the customer and the respective booking confirmation.
3.2 Third parties are not authorized to make promises and/or enter into agreements that deviate from FINNSPIRIT’s Terms and Conditions of Travel or its travel announcements.
3.3 Wildlife sightings or the Northern Lights cannot be guaranteed, as these are nature experiences involving wild animals in their natural habitat or natural phenomena whose behavior and appearance cannot be predicted with 100% certainty. If no sightings occur, no refund of the tour price is possible.
3.4 Services booked by the customer through third-party companies (third-party services) are not included in FINNSPIRIT’s scope of services.
4 Changes to Prices, Services, and the Contract After Contract Conclusion
4.1 FINNSPIRIT reserves the right to unilaterally increase the tour price after the contract is concluded if the increase in the tour price results directly from a circumstance that actually occurred only after the contract was concluded and could not have been foreseen at the time the contract was concluded: a) an increase in the price of passenger transportation due to higher costs for fuel or other energy sources, b) an increase in taxes and other levies on agreed-upon travel services, such as tourist taxes, port or airport fees, or c) a change in the exchange rates applicable to the package tour in question. In the cases mentioned, the travel price will be adjusted to the extent that the increase in the factors listed in a) through c) affects the travel price per person.
Should this be the case, FINNSPIRIT will immediately inform the customer in a clear and understandable manner on a durable medium (e.g., via email) about the price increase and its reasons, and will provide the calculation of the price increase. A price increase is only effective if it complies with the requirements set forth herein and the customer is notified no later than 20 days before the start of the trip. A price increase requested on or after the 20th day prior to the agreed departure date is invalid.
4.2 FINNSPIRIT reserves the right to unilaterally amend contractual terms other than the travel price after the contract has been concluded, provided that the changes are minor, do not impair the overall nature of the booked trip, and are not made in bad faith. This may be the case, for example, with changes to flight times by the airline or with maritime transport, necessary route changes—including changes to flight routes or shipping lines—the substitution of an airline or shipping line to a reasonable extent, particularly due to strikes by transportation companies, necessary changes to the timing and sequence of program items, expansion or reduction of group sizes to a reasonable extent, or the replacement of service providers in the event of their failure to perform, to a reasonable extent—including changes in personnel (replacement of a tour guide due to illness or unavailability)—or alternative sauna visits. FINNSPIRIT must inform the customer of such changes on a durable medium (e.g., via email or text message) in a clear, understandable, and prominent manner. The change is effective only if it meets these requirements and is communicated before the start of the trip.
4.3 Changes or deviations in individual travel services from the agreed terms of the travel contract that become necessary after the contract is concluded and that were not brought about by the tour operator in bad faith are permitted only to the extent that the changes or deviations are not significant and do not impair the overall nature of the booked trip (this also applies, for example, to absences due to illness or other reasons involving individuals who were previously specifically promoted and commissioned by FINNSPIRIT to serve as tour guides; in the event of a tour guide’s absence, FINNSPIRIT will endeavor to replace the tour guide with an alternative person, ensuring that the overall nature of the trip is not impaired as far as possible).
4.4 Any warranty claims remain unaffected to the extent that the modified services are defective.
5 Cancellation by the Customer, Rescheduling, Substitutes
5.1 The customer may cancel the trip at any time prior to the start of the trip. The date of receipt of the cancellation notice by FINNSPIRIT is decisive. The cancellation must be made in writing or in text form (e.g., via email).
5.2 If the customer withdraws from the travel contract (cancellation), FINNSPIRIT forfeits its claim to the travel price but may demand lump-sum compensation in accordance with § 651h II of the German Civil Code (BGB).
To this end, FINNSPIRIT has established the following flat-rate compensation amounts, which are determined based on the period between the notice of cancellation and the start of the trip, the expected savings in expenses for FINNSPIRIT, and the expected revenue from the alternative use of the travel services, expressed as a percentage of the travel price, depending on the customer’s cancellation date, as follows:
up to the 50th day before the start of the trip 20%
from the 49th day to the 32nd day before the start of the trip 35%
from the 31st day to the 15th day before the start of the trip 50%
from the 14th day to the 8th day before the start of the trip 65%
from the 7th day to the 1st day before the start of the trip 80%
on the day of departure or in case of no-show 90%
of the travel price.
Exception to the flat-rate compensation:
FINNSPIRIT reserves the right, instead of applying the flat-rate compensation amounts specified in Section 5.2, to calculate the amount of compensation based on the actual costs it incurred in each individual case and, in addition, to include individual services that were priced separately as part of the bundled services in the travel contract (e.g., accommodations and activities, flights, seat reservations, admission tickets) and/or that FINNSPIRIT must pay to its service providers and, even in the event of the customer’s cancellation, receives no refund or only a partial refund from its service providers, to calculate the cancellation costs for the specified service at 100% or at the amount that FINNSPIRIT can demonstrably prove it has incurred. The above-mentioned flat-rate compensation amounts apply to the remaining travel price.
In doing so, FINNSPIRIT will take into account any expenses saved as well as savings resulting from any alternative use of the travel services and may specifically quantify and document the compensation claimed.
5.3 There is no legal right to make changes to the booking. However, if changes are made at the customer’s request after the trip has been booked (changes regarding the travel dates, destination, point of departure, the accommodation, or the mode of transportation) at the customer’s request after the trip has been booked, FINNSPIRIT may charge a rebooking fee of 75 euros per rebooking transaction. Rebookings are only possible up to the 35th day before the start of the trip, provided that the service providers (e.g., hotels, airlines) also permit this. After that, changes are only possible following prior cancellation of the travel contract under the aforementioned conditions and subject to the customer’s simultaneous re-registration. If the rebooking is necessary because FINNSPIRIT, for example, failed to provide the customer with any pre-contractual information or provided incorrect information pursuant to Art. 250 § 3 EGBGB, the rebooking shall be free of charge.
5.4 The customer may, within a reasonable period before the start of the trip, declare on a durable medium (e.g., via email) that a substitute will assume the rights and obligations under the travel contract in the customer’s place. The declaration is in any case timely if it is received by the tour operator no later than seven days before the start of the trip.
The tour operator may object to the substitute’s assumption of the contract if the substitute does not meet the contractual travel requirements. If a substitute assumes the contract, the substitute and the customer are jointly and severally liable to the tour operator for the travel price and any additional costs incurred as a result of the third party’s assumption of the contract. The tour operator may demand reimbursement of additional costs only if and to the extent that these are reasonable and have actually been incurred by the tour operator. The tour operator must provide the customer with proof of the amount of additional costs incurred as a result of the substitute’s participation.
6 Important Insurance Policies
6.1 No insurance is included in the tour price. FINNSPIRIT strongly recommends purchasing the following insurance policies:

7 Withdrawal and Termination by FINNSPIRIT
7.1 If a minimum number of participants is specified in the trip description or in other documents that have become part of the contract, the tour operator may withdraw from the travel contract up to 28 days before the start of the trip if the minimum number of participants is not reached. If the trip is not carried out for this reason, the customer will be promptly refunded any payments made toward the trip price. FINNSPIRIT may also withdraw from the contract before the start of the trip if it is prevented from fulfilling the contract due to unavoidable, extraordinary circumstances. FINNSPIRIT must then declare its withdrawal immediately upon becoming aware of the reason for withdrawal, and the customer shall be promptly refunded any payments made toward the trip price.
7.2 In any case, FINNSPIRIT is obligated to notify the customer immediately upon the occurrence of the circumstances preventing the trip from taking place and to forward the notice of withdrawal to the customer without delay.
7.3 In the event of cancellation for the reasons stated above, FINNSPIRIT will not reimburse the customer for third-party services, such as flights, that the customer purchased outside the tour operator’s service offering.
7.4 If, despite a corresponding warning from FINNSPIRIT, the traveler causes persistent disruption or behaves in such a manner that is in breach of the contract to the extent that continuing the contractual relationship until the agreed termination date or the expiration of a notice period is unreasonable, or otherwise acts in serious breach of the contract, FINNSPIRIT may terminate the travel contract without notice. In such cases, FINNSPIRIT retains the right to the travel price, less the value of any expenses saved and, if applicable, any refunds from service providers or similar benefits it obtains from the alternative use of the unused services. Any additional costs for return transportation shall be borne by the disruptive traveler.
7.5 If the customer is clearly unable, physically or mentally, to meet the requirements specified in the respective travel description, FINNSPIRIT is entitled to exclude the customer from the travel program in whole or in part.
8 Unused Services
8.1 If the customer does not make use of individual travel services that FINNSPIRIT has offered properly and free of defects—whether due to early return, illness, or other reasons for which the customer is solely responsible—the customer is not entitled to a pro-rata refund of the travel price.
9 Customer’s Obligations, Remedies, Setting a Deadline Before Termination by the Customer, Travel Documents
9.1 The customer must immediately report any defects that arise and request that they be remedied within a reasonable period of time. If FINNSPIRIT was unable to remedy the situation due to the customer’s culpable failure to report the defect, the customer is not entitled to assert the rights specified in § 651m of the German Civil Code (BGB) or to claim damages under § 651n of the BGB. If the customer requests a remedy, the travel defect must be remedied. FINNSPIRIT may refuse to provide a remedy if it is impossible or, taking into account the extent of the travel defect and the value of the affected travel service, would entail disproportionate costs. FINNSPIRIT may provide a remedy by offering a replacement service of equal or higher value. If FINNSPIRIT may refuse to remedy the defect and the defect affects a significant portion of the travel services, it must offer a remedy in the form of appropriate substitute services.
9.2 If a trip is significantly impaired as a result of a defect and FINNSPIRIT fails to remedy the defect within a reasonable period, the customer may terminate the travel contract. The customer is not required to set a deadline only if FINNSPIRIT refuses to remedy the defect or if immediate remedy is necessary. If the contract is terminated by the customer, FINNSPIRIT retains the right to the agreed-upon travel price with respect to the travel services already provided and those still to be provided to complete the package tour; The customer’s claims under Section 651i(3)(6) and (7) of the German Civil Code (BGB) remain unaffected. With regard to travel services that are no longer to be provided, FINNSPIRIT’s claim to the agreed-upon travel price shall lapse; any payments already made in this regard shall be refunded to the customer.
9.3 In the event of disruptions to services, the customer is obligated to cooperate in accordance with the statutory provisions regarding the duty to mitigate damages, to avoid or minimize any potential damages.
9.4 The customer must inform the tour operator if he or she does not receive the necessary travel documents within the time limit specified by the tour operator.
9.5 Arriving on Time: Each customer is personally responsible for arriving on time at the departure point. This applies in particular to flights booked independently or when traveling on one’s own. At airports, the customer must allow sufficient time for check-in and security screening. For international flights, the customer must arrive at the airport at least three hours before the scheduled departure time on the day of departure to allow sufficient time for check-in and security screening; the customer must also allow for such a layover time when booking flights independently. When booking Rail & Fly tickets, the customer also has a duty to cooperate
for all domestic and international flights, to ensure that they select a train connection that allows them to arrive at the airport at least three hours before their flight’s departure time, so that they can arrive at the check-in counter on time, pass through security checks or other checks—such as health screenings—and board the flight at the gate in a timely manner.
9.6 The customer is obligated to carefully assess for themselves prior to the trip—if necessary, with the assistance of expert medical advice—whether participation in the trip, with its specific itinerary and route, is actually compatible with their respective physical condition, physical and mental constitution, and current state of health, given any potentially unfamiliar climatic conditions.
10 Limitation of Liability
10.1 FINNSPIRIT’s contractual liability for damages that are not bodily injury and are not caused by negligence is limited to three times the travel price. This limitation of liability does not apply to claims arising under the Montreal Convention regarding the loss of luggage.
10.2 FINNSPIRIT is not liable for disruptions to services, personal injury, or property damage in connection with services that are merely arranged as third-party services, or that are not part of the travel contract and that the traveler has booked and utilized directly without the tour operator’s mediation.
10.3 Excursions (including theater visits, museums, sporting events, etc.) offered and booked on-site by the local tour guide acting on their own behalf or by other individuals acting on their own behalf at the vacation destination, transportation services, sports activities (skiing, cycling), and rental cars (including snowmobiles and motorcycles) are not part of the package tour contract between the customer and FINNSPIRIT; FINNSPIRIT assumes no liability for such services.
10.4 Tour guides or travel agencies are not authorized to acknowledge claims on behalf of FINNSPIRIT.
11 Rental Cars
11.1 All rental cars are arranged as third-party services. The contractual partner for the vehicle rental is the respective car rental company. The customer is obligated to comply with the rental terms and conditions. In particular, the regulations regarding credit cards, driver’s licenses, and vehicle return apply. FINNSPIRIT is not liable for any service disruptions on the part of the car rental company.
12 Booking a Double Room with Separate Beds
12.1 If, when booking a double room with separate beds, no same-sex roommate has been registered approximately six to four weeks before the start of the trip, the customer will automatically be assigned a double room for single occupancy or a single room (depending on availability). In this case, FINNSPIRIT will charge 50% of the single room or double room for single occupancy surcharge. If the customer does not agree to this, they have the option to rebook to another travel date from FINNSPIRIT’s offerings at no cost, or to cancel the trip.
12.2 For bookings made within one month of departure, FINNSPIRIT will charge the full single room or double room for single occupancy surcharge if no roommate is available.
13 Passport and Visa Requirements, Customs, and Health Regulations
13.1 FINNSPIRIT shall inform the customer, prior to the conclusion of the contract, of the general passport and visa requirements of the destination country, including the approximate timeframes for obtaining visas, as well as health regulations (e.g., vaccinations and medical certificates required by authorities) necessary for the trip and the stay.
13.2 The customer is personally responsible for complying with these regulations. Any adverse consequences, in particular the payment of cancellation fees, arising from non-compliance with these regulations shall be borne by the customer, unless FINNSPIRIT has failed to fulfill or has inadequately fulfilled its pre-contractual duty to provide information through its own fault. In particular, customs and foreign exchange regulations abroad must be observed. The customer is responsible for obtaining and carrying the necessary travel documents and must ensure that their passport or national ID card is valid for the duration of the trip.
14. Duty to Provide Information Regarding Airlines
14.1 EU Regulation No. 2111/2005 on informing passengers of the identity of the operating air carrier requires FINNSPIRIT to inform the customer at the time of booking of the identity of the operating airline for all air transportation services to be provided as part of the booked trip. If the operating airline has not yet been determined at the time of booking, FINNSPIRIT is obligated to inform the customer of the airline or airlines that are likely to operate the flight(s).
As soon as FINNSPIRIT knows which airline will operate the flight, the traveler must be informed. If the named airline changes, FINNSPIRIT must inform the traveler of the change. FINNSPIRIT must immediately take all reasonable steps to ensure that the traveler is promptly informed of the change. 15 Discounts, Special Services
15.1 Special services or discounts advertised by FINNSPIRIT in the brochure, online brochure, website, catalog, or specific tour description—such as early-bird discounts or climate-related discounts—are expressly granted only for tours organized by FINNSPIRIT itself. FINNSPIRIT has no influence over the corresponding policies of other tour operators.
16 Data Protection, Customer’s Right to Object
16.1 FINNSPIRIT informs customers about the processing of their personal data in its Privacy Policy on its website and in its data protection notice. Personal data refers to all data that relates to a specific individual and identifies them, such as name, address, and email address. This data is processed to the extent necessary for the proper handling of the customer’s inquiry, catalog order, or booking request; for the implementation of pre-contractual measures; or for the fulfillment of the travel contract.
Data processing is permitted for the stated purposes pursuant to Article 6(1)(b) of the GDPR. The data will not be disclosed to unauthorized third parties without the customer’s express consent. The customer has the right at any time to access their personal data stored by the tour operator, to request information about it, to have it amended, corrected, or deleted, to restrict its processing, to object to its processing, to have it transferred, or to lodge a complaint with a supervisory authority regarding its processing (all rights under Articles 15 through 20 of the GDPR). The data will be deleted when it is no longer necessary for the performance of the contract or when its storage is prohibited by law. If the customer’s personal data is processed on the basis of legitimate interests pursuant to Article 6(1)(f) of the GDPR, the customer has the right, pursuant to Article 21 of the GDPR, to object to the processing of their personal data, provided there are grounds for doing so arising from their particular situation. The customer may exercise their right to object by sending an email to info@finnspirit.de or by contacting FINNSPIRIT at the address listed below. The data protection officer can be reached at the address listed below with the note “To the Data Protection Officer.”
16.2 By sending a message to info@finnspirit.de, the customer may object to the use or processing of their data for advertising, market research, opinion polling, or marketing purposes.
17 Miscellaneous
17.1 The customer may only bring legal action against FINNSPIRIT at the company’s registered office.
17.2 The invalidity of individual provisions shall not render the entire travel contract invalid. German law shall apply exclusively to the entire legal and contractual relationship between FINNSPIRIT and the customer. If the customer is a merchant, a legal entity under private or public law, or a person whose domicile or habitual residence is abroad, or whose domicile or habitual residence is unknown at the time the action is filed, the place of jurisdiction shall be the registered office of FINNSPIRIT.
17.3 The European Commission provides a platform for online dispute resolution (ODR) for the out-of-court settlement of consumer disputes arising from travel contracts concluded in electronic commerce, which the customer can access at https://ec.europa.eu/consumers/odr. Dispute Resolution before a Consumer Arbitration Board: FINNSPIRIT does not participate in such voluntary dispute resolution procedures and is not legally obligated to do so. There is no internal complaint procedure.
18 General Provisions
18.1 The invalidity of individual provisions of the travel contract and these terms and conditions does not render the entire travel contract and these terms and conditions invalid.

Information on the EU Package Travel Directive
(Form for Informing the Traveler Regarding a Package Tour Pursuant to Section 651a of the German Civil Code)
The combination of travel services offered to you constitutes a package tour within the meaning of Directive (EU) 2015/2302.
Therefore, you are entitled to all EU rights applicable to package tours. The TOUR OPERATOR FINNSPIRIT bears full responsibility for the proper execution of the entire package tour. In addition, FINNSPIRIT has the legally required insurance to ensure the refund of your payments and, if transportation is included in the package tour, to ensure your return transportation in the event of its insolvency.
Key Rights Under Directive (EU) 2015/2302

Travelers receive all essential information about the package tour before concluding the package tour contract.

At least one business operator is always liable for the proper provision of all travel services included in the contract.

Travelers will be provided with an emergency phone number or contact details for a point of contact through which they can reach FINNSPIRIT.

Travelers may transfer the package tour to another person—within a reasonable timeframe and, under certain circumstances, subject to additional costs—provided that the substitute is accepted by FINNSPIRIT for the relevant trip.

The price of the package tour may only be increased if certain costs (such as fuel prices) rise and if this is expressly provided for in the contract. Any necessary price increases will be communicated to the traveler no later than 20 days before the start of the package tour. If the price increase exceeds 8% of the package tour price, the traveler may withdraw from the contract. If FINNSPIRIT reserves the right to increase the price, the traveler also has the right to a price reduction if the relevant costs decrease.

Travelers may withdraw from the contract without paying a cancellation fee and will receive a full refund of all payments if any of the essential elements of the package tour, with the exception of the price, are significantly altered. If the operator responsible for the package tour cancels the tour before it begins, travelers are entitled to a refund and, under certain circumstances, to compensation. If the operator must cancel the package tour because the minimum number of participants has not been reached by 21 days before the start of the tour, the traveler will receive a full refund of all payments, without any additional compensation.

Travelers may withdraw from the contract without paying a cancellation fee if extraordinary circumstances arise before the start of the package tour, for example, if there are serious security issues at the destination that are likely to affect the package tour.

In addition, travelers may withdraw from the contract at any time before the start of the package tour upon payment of a reasonable and justifiable cancellation fee. See the cancellation terms in FINNSPIRIT’s General Terms and Conditions (ARB).

If, after the start of the package tour, essential components of the package tour cannot be carried out as agreed, the traveler must be offered reasonable alternative arrangements at no additional cost. The traveler may withdraw from the contract without paying a cancellation fee (in the Federal Republic of Germany, this right is referred to as “termination”) if services are not provided in accordance with the contract and this has a significant impact on the provision of the contractual package tour services, and the tour operator fails to remedy the situation.

The traveler is entitled to a price reduction and/or compensation if the travel services are not provided or are not provided properly.

The tour operator shall provide assistance to the traveler if the traveler finds themselves in difficulty.

In the event of the insolvency of the tour operator or—in some Member States—the travel agent, payments shall be refunded. If the tour operator or, where applicable, the travel agent becomes insolvent after the start of the package tour and transportation is part of the package tour, the traveler’s return transportation is guaranteed.
